SPB 27: Common Law (USA)
Important trading partners of Germany and Bavaria, both within the European Union and beyond, are common law or mixed legal systems. The United States is of particular relevance here given the size of its economy and the increasing number of German and American companies that seek to develop new or expand existing transatlantic business activities. Schwerpunktbereich 27 Common Law (USA) provides a unique specialization that combines practically relevant knowledge in key areas of U.S. law with problems arising from cross-border relationships more generally as well as wider themes of comparative private and constitutional law. This Schwerpunkt is both an alternative and/or a supplement to the Certificate of Higher Education in Common Law and the LL.B (University of London).
The Schwerpunkt provides an introduction to the common law tradition as well as courses on U.S. tort law (including the commercially relevant area of products liability), U.S. contract law (including the Uniform Commercial Code) and selected issues of U.S. constitutional law that provide a better understanding of how American law plays out in legal practice (for example federalism or the U.S. court system). A short course on U.S. civil procedure and a seminar that invites students to explore in depth a topic selected from a wide range of legal areas complement these core offerings.
Classes are held entirely in English using a variety of teaching methods such as Socratic dialogue, wider class discussion, and short lectures. Students cover the same materials as their peers at leading U.S. law schools. Exams are also held in English.
